A medical board will be set up at a Mumbai hospital to examine the condition of an alleged rape survivor who wants to abort her 24-week-old ‘abnormal’ foetus, the Supreme Court yesterday said.
A bench headed by Justice J S Khehar asked the medical board to examine the woman at King Edward Memorial College and Hospital at Mumbai, by Saturday and submit its report to the apex court on Monday.
The bench also comprising Justice Arun Mishra said the report of the medical board with regard to the woman’s condition will be assessed and if necessary, some directions will be passed.
Senior advocate Colin Gonsalves, appearing for the woman, will ensure that she reaches the hospital by tomorrow for her examination, it said.
Solicitor General Ranjit Kumar said that the Centre was ready to constitute a medical board at All India Institute of Medical Sciences (AIIMS) where the woman could be examined.
Gonsalves said that the condition of the woman, who is at present in Mumbai, is very bad and she will not be able to travel to Delhi. “Delay in these matters is very bad. There should not be any delay in these matters,” the bench said, adding that a larger issue of law will be dealt with separately.

Replying to a discussion on 'tainted' ministers, in the Lower House, the CM also made it clear that former Revenue Minister Eknath Khadse -- who resigned recently in the wake of series of allegations against him -- has been given clean chit in the PA bribery case.
Khadse's name does not figure in the Anti-Corruption Bureau's (ACB) charge sheet in the case of graft by Gajanan Patil, an alleged personal assistant of Khadse, Fadnavis said.
Patil was trapped by the ACB on May 14 for allegedly demanding Rs 30 crore from a Mumbai-based social entrepreneur Dr Ramesh Jadhav. Fadnavis said Vadodara-based hacker Manish Bhangale had met him with alleged call records from Dawood's Karachi residence to show that Khadse was in frequent touch with the underworld don.
"When Bhangale met me, I immediately asked the Crime Branch to conduct an inquiry," Fadnavis said. "No charge has been proved against minister Jaykumar Rawal," he said. Similarly, there is not a single crime registered against Minister of State Ravindra Chavan, he added.
Fadnavis also defended minister Sambhaji Patil Nilangekar, who has been found to be closely associated with a company listed as a wilful defaulter by the Bank of Maharashtra.
Nilangekar, Minister for Labour, Earthquake Rehabilitation and Ex-servicemen's Welfare, is a guarantor for a loan that was a non-performing asset (NPA) and declared as a "fraud account" with an outstanding balance of Rs 49.29 crore owed to two state-owned banks ¿ Bank of Maharashtra and Union Bank of India.
Further, the Central Bureau of Investigation (CBI) last year filed a chargesheet in a case of cheating lodged by the banks after finding that the mortgage deed papers for the loan had been tampered with.
"As the matter pertains to a national bank, the inquiry is being conducted by CBI," Fadnavis said. Nothing more should be read into it, he added.
"The Opposition zeroed in on a figure (of ministers to be targeted). Just because our government completed 20 months, 20 ministers were targeted," Fadnavis said.
Meanwhile, former CM Prithviraj Chavan told reporters later that CM sought Khadse's resignation after allegations. "Why should there be one yardstick for Khadse and a different one for other ministers," Chavan said. Talking to reporters, NCP MLA Jayant Patil said Fadnavis has yet not given clean chit to Khadse in the MIDC land purchase at Bhosari in Pune.
"The CM says the case is subjudice. Cases against some ministers are also subjudice but they continue to remain in the ministry," Patil said.
"Why should there be a different criterion for Khadse and other ministers," Patil said.

The issue was raised by Congress MLC Sanjay Dutt, through a point of propriety, who questioned the government on its resolve to reduce the weight of school bags.
"80 per cent of the issue regarding the weight of school bags has been solved in the State Board schools. However, it's difficult to implement it in CBSE, ICSE, IGSE & IB Board schools as their Boards, work-books, extra-curricular activities are different. We are in touch with them and trying to sort the matter out," the minister said.
Tawde conceded that implementation of a government resolution (GR) on directions to be followed by schools in reduction of weight of school bags was not up to the mark in CBSE, ICSE, IGSE & IB Board schools.
"The government is trying to put-in place an effective implementation authority. Our initial approach was to lay stress on counselling and assisting the educational institutions to resolve this issue," he said.
Dutt demanded that the state government set a timeframe to ensure effective implementation of the GR, to which Tawde replied, "We will implement it at the earliest."
The government had set up a committee on the reduction of weight of school bags for students soon after a petition was filed in the Bombay High Court.
As per the report submitted by the panel, students are lugging school bags 20-30 per cent heavier than what children of their age should carry.

It has been learnt that though MHADA is yet to issue an NOC, shopkeepers claim they have received a verbal go-ahead for the commencement of business on the ground floor. With the power supply yet to be restored fully, shopkeepers are using inverters. While the iconic Café Mondegar has commenced operations, another biggie, Metro Shoes, will start operations soon.
Though the interim structural audit report states that the building was stable enough and did not need to be razed, it clearly mentions that B and C wings require extensive repairs before they are reoccupied. Even the upper floors of the A wing require minor repairs. A detailed audit report is awaited.
While the interim report states that A wing’s ground floor is safe, another empanelled architect ruled out the use of C wing’s ground floor.
When mid-day visited the spot, a few shops located on the ground floor of all the wings were operational. Even the hawkers have reclaimed their spots on the footpath.

Speaking to mid-day, Raj Kalapi, of Kalapi stores, said, “We are facing a lot of problems. There is no electricity and the dirty water from the floor above seeps into the shop, emitting a foul smell. We have opened the shop so that it dries out. We are not doing full-fledged business again.” Like Kalapi, several shopkeepers are awaiting the NOC from MHADA.
His son Wesley said that the MHADA and BMC officials are kept in the know about a few shopkeepers opening their shops. “But if they object, we will shut shop. We are co-operating with the authorities.”
Another owner, who was sitting in his dimly lit shop, said, “The BEST won’t give us electricity unless MHADA orders it. And MHADA is awaiting the final audit report. We are suffering tremendous losses. Business is bleak and we are in dire straits.”
Shopkeepers claiming that the more influential tenants used their contacts to restore power supply to their respective establishments.
